Rihanna's legal battle with David LaChapelle her S & M music video is on his way to trial after a judge in New York, the famous photographer permission to pursue his case against the singer.
Celebrity snapper sued the star earlier this year over allegations that her controversial promo, which was banned in 11 countries worldwide, "directly derived" from some of his images.
The case went to court in New York and in a judgment released Thursday, U.S. District Judge Shira Scheindlin noted alleged similarities between music video and Lachapelles work and paved the way for the trial to go to trial.
Judge Scheindlin dismissed Lachapelles claims trademark symbol infringement, unfair competition and unjust enrichment, but allowed him to pursue his claim on copyright violation.
A Conference of the parties is scheduled for the 10th August.
